f0302 On order of the Court, the application for leave to appeal from the June 15, 1999, decision of the Court of Appeals, is considered, and it is GRANTED, limited to the following issues (1) does MCL 229.1 et seq; MSA 9.281, et seq, authorize unconstitutional taking of private property for private use; and (2) may the extent of the use sought be considered in determining whether to invoke the statutory procedure. We invite the Attorney General to intervene in the action in this Court under MCL 14.101; MSA 3.211. The Real Property Law and Public Corporation Law Sections of the State Bar of Michigan are invited to file briefs as amicus curiae. Markman, J., not participating.
